This position is for a Litigation and Compliance Counsel supporting consumer mortgage servicing and operations. Litigation and Compliance Counsel reports to Senior Counsel, SVP/Deputy General Counsel, and the EVP/General Counsel, and is responsible for managing litigation and contested foreclosures/evictions as well as providing legal advice and interpretations of regulations to support the Compliance Department and operation.

    WHAT YOU WILL DO:
    • Provide legal advice and service by combining skill in litigation with sound business reasoning and knowledge of objectives of the company or assigned business units.
    • Supervise and actively direct outside counsel.
    • Work closely with investors and outside counsel to ensure adherence to regulatory policies and client objectives.
    • Use business and legal judgment to balance an appropriate level of risk against the business needs in a particular situation. Operate within the framework of allowable corporate behavior, and legal and regulatory compliance.
    • Draft/review discovery, settlement agreements, pleadings, and briefs.
    • Analyze legislation that impacts the company and assist the company in responding to inquiries from government agencies.
    • Prepare and manage a litigation budget.
    • Plan, guide, and/or oversee the performance of legal support staff.
    • Provide support for the Compliance Department and operations generally.
    • Help to ensure compliance with all applicable state and federal laws impacting the mortgage servicing business.
    • Respond to inquiries of a legal or compliance nature from within the operation as well as from current and prospective clients.
    • Work cooperatively with the Compliance Department to keep up to date with all changes to the laws and advising the business of changes in a timely manner.
    • Reviewing escalated complaints received by the Complaint Resolution Unit and revising drafted responses as appropriate, facilitating communication between the business and state consumer affair or licensing agencies with regard to such complaints.
    • Responsible for meeting legal requirements and following internal policies.
      WHAT WE'RE LOOKING FOR:
      • 2-5 years' experience in the mortgage industry - in house experience preferred.
      • Extensive knowledge of federal and state laws impacting mortgage servicing such as TILA, ECOA, FCRA, FDCPA, RESPA, the Fair Housing Act, the Homeowners Protection Act, predatory lending laws, state foreclosure laws and the U.S. Bankruptcy Code.
      • Litigation experience preferably in default servicing, including foreclosure and REO related matters.
      • High degree of professional ethics, integrity, and gravitas.
      • Able to provide outstanding client service in a dynamic and fast-paced environment and collaborate with colleagues of all levels.
        • J.D. degree and licensed to practice law and in good standing in at least one state/jurisdiction in the United States Superior legal research, drafting, writing and organizational skills.
        • Ability to develop legal strategy and proactive strategic thinking.

          Position Type and Expected Hours of Work This is a full-time position. Days and hours of work are Monday through Friday, 8:00 a.m. to 5 p.m. Overtime may be required.
